Trust agreement v4.3
about 1 month ago by ReadMe API
- Clean recovery when title is lost to forces outside the owner's control. Owners, their heirs, and lenders are now covered when record title leaves the trust by external operation of law, such as a tax sale, judicial or nonjudicial foreclosure, eminent domain, escheat, or court-confirmed adverse possession. The trust dissolves automatically when the external instrument is recorded, so the token no longer lingers onchain with no way to close out the structure. Whoever holds the token keeps authority to pursue and collect any residual proceeds (tax-sale surplus, condemnation awards, refunds, insurance recoveries), and if a court later sets the external transfer aside, the trust is reinstated as if it had never lapsed, with the current token holder restored as beneficiary. (Added as a new Section 10.5 with supporting cross-reference updates.)
